These Terms of Service (the “Agreement”) govern your use of our photography services and website (adrianbonetphotography.net). By accessing or using our website or booking our services, you agree to comply with and be bound by the following terms and conditions. Please read this Agreement carefully before using our services. If you do not agree to these terms, do not use our website or services.
1. Services Provided
Adrian Bonet Photography provides professional wedding and event photography services in Cancun, Mexico, and surrounding areas. Our services include but are not limited to:
Pre-Wedding Consultations: We offer consultations to discuss your vision, style preferences, and important details for the event. This ensures that we tailor our services to your specific needs.
Photography Coverage: Our photographers provide full coverage of the wedding or event, capturing moments throughout the day, including pre-ceremony, ceremony, reception, and any special moments you request.
Post-Production and Editing: After the event, we carefully edit and enhance your images to provide the highest quality results. This includes color correction, retouching, and other enhancements to ensure your photos look their best.
Digital and Physical Delivery of Photos: You will receive a personalized online gallery for viewing and downloading your images. Prints, albums, or other physical products can be ordered through the gallery.
We reserve the right to update or alter our services at any time. Any changes will be communicated in advance to clients with ongoing contracts.
2. Booking and Payment
To confirm your wedding date, we require a signed contract and a non-refundable deposit of 30% of the total booking fee. The remaining balance is due 30 days prior to the event. Failure to pay the balance by the due date may result in the cancellation of the contract and the forfeiture of your deposit.
Payment Methods: We accept payments via wire transfer, credit card (via PayPal or Stripe), or other agreed-upon methods. You will receive an invoice for each payment made, and your final invoice will reflect any additional services or products requested.
Booking Confirmation: Your booking is only confirmed once the signed contract and deposit are received. In the event that your chosen date is already taken, we will notify you as soon as possible and suggest alternative dates.
3. Cancellations and Refunds
Cancellations by Client: If you need to cancel or reschedule, the deposit is non-refundable. Cancellations made within 30 days of the event will incur a charge of up to 50% of the total agreed-upon price. Cancellations made less than 14 days before the event will incur the full cost of the booking. We recommend considering event insurance to protect against unexpected changes.
Cancellations by Photographer: In the rare event that we must cancel or reschedule due to unforeseen circumstances (such as illness, emergencies, or equipment failure), we will notify you immediately. We will either provide a full refund or offer to reschedule the photography session, subject to availability. If we are unable to find a suitable alternative date, you will receive a full refund of all payments made.
Force Majeure: Neither party will be held liable for failures to perform under this Agreement due to circumstances beyond their control, such as natural disasters, war, terrorism, pandemics, or government restrictions. If such an event occurs, we will make every effort to reschedule or find an alternative solution.
4. Client Responsibilities
Venue Access: The client is responsible for ensuring the photographer has access to all areas of the venue where photography is required, including during restricted times (such as ceremonies or speeches). The photographer should not be obstructed by guests or other vendors while performing their duties.
Meal and Comfort Arrangements: If your photography coverage extends over several hours, we recommend providing a meal and rest breaks for the photographer and assistant, especially if there is a long duration between events (e.g., between ceremony and reception).
Permissions: The client is responsible for ensuring the photographer is permitted to photograph in the venue or location, including obtaining any necessary permits or access rights. If additional fees are required for permission to photograph at the venue, the client must cover these expenses.
Model Release: By booking our services, you grant Adrian Bonet Photography permission to use your images for promotional purposes, including but not limited to social media, website content, and marketing materials. If you prefer not to have your images used in this way, please notify us in writing during the booking process.
5. Delivery of Photos
We strive to deliver high-quality edited photos within 4-6 weeks after the event. You will receive a personalized online gallery where you can view, download, and share your images. You will also have the option to purchase prints, albums, or additional products through the gallery.
Rush Delivery: If you require a faster turnaround, please inquire about rush delivery options for an additional fee.
Prints and Albums: Printed photos and albums will be delivered separately and may take additional time, depending on production times and shipping.
Photo Retention: Your online gallery will remain active for 1 year from the date of the event. After this period, your photos may be archived or deleted. If you need extended storage, please contact us before the gallery expiration date.
6. Limitation of Liability
While we take great care in capturing and preserving your photos, Adrian Bonet Photography’s liability for any errors, omissions, or damages is limited to the amount paid for the specific photography services rendered. In no event shall we be held responsible for indirect, incidental, special, or consequential damages, including loss of enjoyment, loss of time, or loss of revenue.
- Equipment Failure: In the unlikely event of technical failure (e.g., camera malfunction), we will make every reasonable effort to capture and preserve the event with backup equipment. However, we are not liable for any failure to deliver images in the event of unforeseen technical issues.
7. Intellectual Property Rights
All images created during the event, including raw and edited images, remain the intellectual property of Adrian Bonet Photography and are protected by copyright law. As a client, you are granted a personal license to use these images for non-commercial purposes, such as printing or sharing on social media. Any commercial use or reproduction of the images without express permission is prohibited.
Social Media: We encourage sharing your photos on social media, but please credit Adrian Bonet Photography when doing so.
Usage Rights: If you wish to use the images for commercial purposes, such as advertising, magazine publications, or selling prints, you must obtain written permission from us, and additional licensing fees may apply.
8. Privacy Policy
We value your privacy and are committed to protecting your personal information. When you book our services, we collect personal details such as names, email addresses, and event information. This data is used exclusively for fulfilling your booking, delivering your photos, and communicating with you about your event.
We will not share, sell, or rent your personal information to third parties, except as required by law or for necessary business operations (e.g., payment processors, shipping companies). Our website may use cookies to enhance user experience, and you can choose to disable cookies through your browser settings.
9. Governing Law
This Agreement is governed by and construed in accordance with the laws of Mexico. Any disputes arising from or related to this Agreement shall be resolved in the courts located in Cancun, Quintana Roo, Mexico. By agreeing to these terms, you consent to the exclusive jurisdiction and venue of such courts.
10. Modifications to Terms
Adrian Bonet Photography reserves the right to update or modify these Terms of Service at any time. Any changes will be posted on this page, and the date of the most recent update will be listed above. It is your responsibility to review these terms periodically to stay informed of any updates.
